California has extended the amount of time employers are required to allow workers who are on leave for pregnancy or related medical conditions to be on disability insurance coverage.
Senate Bill 299 was signed into law by Governor Jerry Brown and will take effect on January 1, 2012. The law allows women on maternity leave to remain on disability insurance for up to 16 weeks.
The law, which got little attention as it moved through the state Assembly and Senate, applies to companies with five or more workers, while FMLA applies to employers with 50 or more workers.
News reports are calling the bill a replica of the 1993 U.S. Medical Leave and Family Act, with one of the only differences being the amount of time that is allowed to remain on disability insurance. The 1993 legislation gave employees 12 weeks as opposed to the 16 weeks the new California bill allows.
According to the American Pregnancy Association, there are more than 6 million pregnancies a year in the United States, 4 million of which are live births.
